New York City DOB Article 301 Maintenance of Building

Article 301: Maintenance of Buildings

§28-301.1 Owner’s responsibilities. All buildings and all parts thereof and all other structures shall be maintained in a safe condition. All service equipment, means of egress, materials, devices, and safeguards that are required in a building by the provisions of this code, the 1968 building code or other applicable laws or rules, or that were required by law when the building was erected, altered, or repaired, shall be maintained in good working condition. 


The owner shall be responsible at all times to maintain the building and its facilities and all other structures regulated by this code in a safe and code-compliant manner and shall comply with the inspection and maintenance requirements of this chapter.

Chimneys, smokestacks or similar devices for conveying smoke or hot gases to the outer air and the incinerators, stoves, furnaces, fireboxes or boilers to which such devices are connected, shall be maintained so as not to create a fire.

New York City DOB Article 302: Maintenance of Exterior Walls

Beginning on January 1st, 2024

To prevent a danger to the public, New York City has initiated a new rule to require inspections of parapets and appurtenances within the city, building owners must have an annual observation and report of the parapets and appurtenances on all buildings within New York City as per Section 28-301.1.1 of the New York City Administrative Code. and in addition the NYCCS™ recommends taking advantage of the Clean & Safe Chimney Program having the chimney cleaned and inspected BOOK NOW! 


§28-301.1.1 Parapets. 

A building’s parapet shall be maintained in a safe condition. A building owner must have an annual parapet observation performed as described in the rules of the department. This observation must be performed on all buildings, regardless of height.


§28-302.1 General.

A building’s exterior walls and appurtenances thereof shall be maintained in a safe condition. 

All buildings greater than six stories shall comply with the maintenance requirement of this article.

What is a appurtenance & appurtenant?

The word 'appurtenance' means a  subordinate "chimney" part or adjunct to something else "exterior, interior walls, floors, and parapet", but something that might be considered as an in integral or necessary part of the whole "structural system"

Appurtenant structure "Appurtenant structure" includes but is not necessarily limited to a cornice, parapet architectural terra cotta, projecting and freestanding ornamentation, exterior fire escape, balcony, marquee, light fixture, "chimney", or sign and its support structure.

New York City DOB Article 303: Periodic Boiler Inspections

Periodic Boiler Inspections

The key components of a boiler include the burner, combustion chamber, heat exchanger, flue system, combustion air system, and boiler controls. Equipment, such as boilers and all their parts, shall be tested and inspected, to ensure safe operations.

Verify that there is no blockage or obstruction in the base of chimney.


New York City building codes, specifically the Fuel Gas Code, Mechanical Code, and Building Code, address chimney and vent systems. These codes include requirements for cleanouts, flue gas passageways, and annual inspections to ensure proper ventilation and safety. 


INSPECTION CODE: NFPA 211.14.1 Annual Inspection
Chimneys, Fireplaces and vents shall be inspected at least once a year in accordance with the requirements of 15.1.

CLEANING CODE: NYC FGC 501.15.2 Flue Passageways
The flue gas passageway shall be free of obstructions and combustible deposits and shall be cleaned.

What is a flue system?

 A flue is a duct, pipe, or opening in a chimney for conveying exhaust gases from a fireplace, furnace, water heater, boiler, or generator to the outdoors. Historically the term flue means the chimney itself.
